HIRE TERMS SUMMARY

1. This is a summary of the hire terms and conditions that apply when hiring equipment from Property Maintenance SA. For full terms and conditions, go to www.PropertyMaintenanceSA.com By hiring equipment from Property Maintenance SA, you agree that you have read and accepted the full terms.

2. The hire period starts when the equipment is picked up or delivered to you. It ends the later of the end date you selected when applying for hire, the date the equipment is returned to us, or the end of the wet hire (if any).

3. You must pay the hire fee for the whole hire period. You must also pay additional costs including:

delivery and pick up charges (if applicable),

the costs of refuelling and cleaning (if you have not done so),

traffic and parking offences, and any costs we incur trying to recover money or equipment from you.

You must pay all known charges in advance.

Any new charges must be paid by COD.

We may place a hold on your credit card to secure payments.

4. The equipment is at your risk once picked up by or delivered to you.

You must check the equipment on receipt and notify us of any damage within one hour.

You must return the equipment to us in the same condition as you received it.

5. To collect the equipment, you must have a vehicle with appropriate towing capacity to tow the equipment.

If you do not, we may deliver or collect the equipment for an additional fee.

6. Title to and ownership of the equipment always remains with Property Maintenance SA.

You must not remove our branding or serial numbers from the equipment.

We may enter your job site or premises to recover equipment if you fail to return it.

7. You must notify us as soon as possible (within 24 hours) if you become aware of any mechanical fault, defect or malfunction.

If we agree that there is an issue, we may repair or replace the equipment or waive the hire fee.

We won’t do this if you misused, abused or neglected the equipment.

8. While you have the equipment, you are responsible if it is lost or damaged beyond ordinary fair wear and tear, as outlined on our website.

You must immediately notify us of any damage or theft (as well as the police for a theft).

9. You must pay for any damage of the equipment.

All our equipment is fully insured.

In the event of a claim, the insurance excess is $2,000. You will be liable to pay the excess.

The insurance does not cover damage from your failure to secure the equipment when not in use; incorrect use of the equipment; use underground, in connection with asbestos, oil, gas or geothermal drilling or wells, on a watercraft, or for an unlawful purpose; or failure to maintain the equipment.

10. You may choose wet hire, which means that we provide an operator for the equipment, at an hourly rate.

We may invoice for wet hire upfront, during the project or at the end.

Failure to pay an invoice may lead to delays.The operator is our contractor or employee.

You are responsible for any damage caused by the operator following your directions.

You must ensure that the job site is safe and advise our operator of any health & safety requirements.

11. You agree that anyone operating the equipment is adequately educated and/or experienced to operate or use the equipment, has all necessary licences, isn’t suffering any impairment and isn’t under the influence of any alcohol or drugs.

You must complete logbooks and perform daily inspections.

12. Property Maintenance SA doesn’t give any warranties in respect to the equipment, other than the manufacturer’s warranty.

You agree to release and indemnify us for: loss of or damage to the equipment; your negligence or breach of the agreement; or damage to property, personal injury or death caused by you or any person you allow to use the equipment.

13. You agree that we may register on the Personal Property Securities Act to secure our interest in the equipment. You must do all things to allow us to make this registration.

14. We may collect, hold and use your personal information for any purpose connected with our business including direct marketing, debt recovery and credit reporting.

15. We may terminate the hire immediately if we believe the equipment may be at risk or if you have breached any terms of the hire agreement.

By checking the box below, I hereby acknowledge, agree, and accept these statements are true and correct:

1. I have read and understand the Property Maintenance SA Hire Agreement.

2. The representations and warranties provided by me in the Property Maintenance SA hire Agreement are true and correct.

3. I may be liable for “Additional Costs” and Property Maintenance SA may charge my credit card directly for these “Additional Costs” in accordance with the Property Maintenance SA Hire Agreement.

4. I understand the load capabilities and restrictions of the Equipment and agree to not overload or incorrectly load any Equipment.

5. I, together with any person(s) who will be operating or using the Equipment, will complete any training required (not limited to watching safety videos) prior to using the Equipment and will only operate and use the Equipment in accordance with that training.

6. It is my responsibility to operate the Equipment safely.

7. By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper.

Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature.
